Terms and Conditions of Entry into Adam Dineley’s Easter Competition (the “Promotion”)

Terms and Conditions
1. The promoter is Adam Dineley from Elders Real Estate Rockingham & Baldivis – Robian Holdings Pty Ltd (ABN: 42084750265) , 8/2-6 Council Avenue, Rockingham WA 6168
2. Adam’s Easter Competition 12:00am AWST on Saturday, 1st March 2025 and closes at 11:59pm AWST on Wednesday, 30th April 2025
3. To be eligible to enter the Promotion, you must:

  • 3.1 reside in Australia;
  • 3.2 be 18 years or over;
  • 3.3 accept and comply with these Terms and Conditions

4. You will automatically receive one entry into the Promotion if:

  • 4.1 you are the owner of a property situated in Western Australia (the Property);
  • 4.2 you have an Appraisal with Adam Dineley of Elders Real Estate Rockingham & Baldivis in the months of March and April 2025
  • 4.3 There is a limit of one entry per Property. If more than one owner of a Property seeks to enter the Competition, the prize will be awarded to all owners and divided equally. For example, two owners $100 voucher will be awarded to each owner.
  • 4.4 The prize consists of a $200 Voucher for Crown Perth (the Prize), payable to one winner during the Competition period.

5.  Competition draw process:

  • 5.1 The winner will be determined by a random draw conducted by Adam at 8/2-6 Council Avenue, Rockingham WA 6168 on Monday the 5th of May 2025.
  • 5.2 The winner will be notified by telephone and email within 7 days of the draw; and
  • 5.3 Adam will provide the Prize to the winner via email or in person which ever the winner would prefer.

The winner agrees to participate and cooperate, as required by Adam, in all publicity activities relating to the Competition, including, without limitation, being interviewed, photographed, filmed and recorded, and authorises Adam to use that content for promotional, marketing and publicity purposes.

8. The Promoter reserves the right to:

  • 8.1 Confirm your entry to the Competition is valid;
  • 8.2 seek further clarification from you in relation to your entry and compliance with these Terms and Conditions;
  • 8.3 Disqualify you if:
    a) tamper with or benefit from tampering with the entry process or with the operation of the Competition.
    b) act in a disruptive manner or act with the intent or effect of annoying, abusing, threatening or harassing Adam, related bodies corporate or their respective officers, employees, agents or contractors; or
    c) contravene these Terms and Conditions.

9. Adam’s decisions in relation to the Competition, including your eligibility to enter the Competition and the drawing process, are final and Adam is not obliged to correspond with you in relation to these matters.

10. Adam, related bodies corporate and their respective officers, employees, agents and contractors are not responsible for:

  • 10.1 lost, illegible, misdirected, incomplete or damaged entries;
  • 10.2 incorrect or inaccurate transcription of information, human error, technical malfunctions or delayed entries;
  • 10.3 the failure to fully execute a selling agency agreement during the Competition Period.

11. To the extent permitted by law, Adam excludes all:

  • 11.1 liability to you for any loss, damage, claim or expense that you suffer or incur in connection with this Competition and the Prize; and
  • 11.2 warranties, representations or guarantees (Warranties) regarding the Competition and the Prize, including any Warranties which may have been made in the course of advertising or promoting the Competition.

12. You release Adam and related bodies corporate from any liability, cost, damage or expense arising out of, or in connection with, the Competition and the Prize.

13. You indemnify Adam and related bodies corporate against all claims, costs, liabilities, losses and expenses which Adam or related bodies corporate pays, suffers, incurs or is liable for arising out of or in connection with your breach of these Terms and Conditions.

14. By participating in this Competition, you acknowledge and agree that Adam:

  • 14.1 will collect and use your personal information in order to conduct the Competition;
  • 14.2 may disclose your personal information to related bodies corporate, officers, employees, agents or contractors in order to conduct the Competition; and
  • 14.3 may use your personal information for future promotional, marketing and publicity purposes unless otherwise directed by you in writing.

15. If for any reason this Competition is not capable of running as planned, Adam reserves the right in his sole discretion to cancel, terminate, modify or suspend the Competition.

16. You are liable for any taxes, duties or other applicable charges that may be due and payable, for whatever reason, resulting from participating in the Competition or receiving the Prize.

17. Any dispute arising out of or in relation to the Competition shall be governed by the laws of Western Australia.
